These Terms of Service ("Terms") govern your use of the Inceptimind platform and services. By accessing or using our services, you agree to be bound by these Terms.
1. Services
Inceptimind provides an AI-powered messaging automation platform that enables businesses to create, deploy, and manage chatbots across messaging channels including WhatsApp, Instagram, and Facebook. Our services include:
- AI-powered and flow-based chatbot creation
- Multi-channel messaging management
- Knowledge base and vector search
- Analytics and visitor intelligence
- Lead capture and management
2. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must notify us immediately of any unauthorized access to your account.
- You must be at least 18 years old to use our services.
3. Plans and Billing
- Our services are offered under various subscription plans with different features and limits.
- All plans include a one-time setup fee as specified at the time of purchase.
- Subscription fees are billed monthly or annually based on your chosen billing cycle.
- Prices are in Indian Rupees (INR) unless otherwise specified.
- We reserve the right to modify pricing with 30 days' notice.
- Usage beyond plan limits may incur overage charges as specified in your plan.
4. Acceptable Use
You agree not to use our services to:
- Send spam, unsolicited messages, or bulk messaging that violates platform policies
- Harass, threaten, or harm any individual
- Distribute malware, viruses, or other harmful content
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the platform for any fraudulent or deceptive purposes
5. Messaging Platform Compliance
When using our services with third-party messaging platforms (WhatsApp, Instagram, Facebook), you agree to comply with:
- Meta's Business Messaging Policies
- WhatsApp Business Policy and Commerce Policy
- All applicable platform-specific terms and guidelines
Violation of platform policies may result in suspension of your messaging channels by the respective platform providers.
6. Data Ownership
- Your Data: You retain full ownership of all content, data, and configurations you upload to our platform.
- End-User Data: You are responsible for complying with applicable data protection laws regarding data collected from your end-users through bots.
- Our Platform: We retain all rights to the Inceptimind platform, technology, and intellectual property.
7. Service Availability
- We strive to maintain high availability but do not guarantee uninterrupted service.
- We may perform maintenance that temporarily affects service availability.
- We are not liable for downtime caused by third-party services (Cloudflare, Meta, Groq, etc.).
8. Limitation of Liability
To the maximum extent permitted by law:
- Inceptimind shall not be liable for any indirect, incidental, special, or consequential damages.
- Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
- We are not responsible for the content or accuracy of AI-generated responses.
9. Termination
- You may cancel your subscription at any time through your account settings or by contacting us.
- We may suspend or terminate your account for violation of these Terms.
- Upon termination, your data will be retained for 30 days, after which it will be permanently deleted.
- Setup fees are non-refundable.
10. Modifications
We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or through our platform. Continued use of our services after changes constitutes acceptance of the modified Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Gujarat, India.
